License agreement for ContentSaver Professional This End-User License Agreement (EULA) is a legal agreement between you (either an individual or a single entity) and macropool GmbH (MACROPOOL) for the software product identified above, which includes associated SOFTWARE components and may include associated media, printed materials, and online or electronic documentation (SOFTWARE PRODUCT). The SOFTWARE PRODUCT also includes any updates and supplements to the original SOFTWARE PRODUCT provided to you by MACROPOOL. By installing, copying, downloading or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE PRODUCT. 1. Copyright All title and copyrights in and to the SOFTWARE PRODUCT, the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by MACROPOOL. All title and intellectual property rights in and to the content that may be accessed through use of the SOFTWARE PRODUCT is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This EULA grants you no rights to use such content. You may not copy the printed materials accompanying the SOFTWARE PRODUCT or redistribute excerpts of Help. It is not allowed to attempt to reverse engineer, disassemble or decompile and change the enclosed program documentation of the SOFTWARE PRODUCT. 2. Trial Version License You may evaluate the Trial Version for maximum of thirty usage days, after which you must purchase a Full Version from MACROPOOL or remove the software from your computer. You may allow other users to evaluate copies of the Trial Version. All Trial Version users are subject to the terms of this agreement. 3. Distribution of the Trial Version The Trial Version software may be freely distributed, provided that: Such distribution includes only the original setup archive supplied by MACROPOOL. You may not alter, delete or add any files in the distribution archive. The limited evaluation nature of the Trial Version software is not misrepresented. No money is charged to the person receiving the software, beyond reasonable cost of packaging and other overhead. Your distribution of the SOFTWARE will not entitle you to any compensation from MACROPOOL. 4. Product Licensing The SOFTWARE PRODUCT is licensed, not sold. License data for the SOFTWARE PRODUCT consists of the following parts: Name of the licensee (either an individual or a single entity), License date (date when you ordered the license) Personal license key (e.g., 8405-8186-1019-3) Number of workstations The input of these license data turns the trial version into a licensed version of the SOFTWARE PRODUCT. The copyright of the license data is owned by MACROPOOL. You are not allowed to refer the license data to third party or publish it (for example, on the Internet). You are not allowed to rent out, to lease or to lend this license data. The License data is not part of the SOFTWARE PRODUCT itself and can only be saved and be used by an individual or a single entity, that acquired it. With the licensing, you declare yourself agreed with the check up of the data belonging to it and the internal storage of the data at MACROPOOL. MACROPOOL is obliged, not to pass your license data and personal data at third. For each workstation, a single license of the SOFTWARE PRODUCT must be acquired. If you have acquired a license for one single workstation, you cannot use the license data on several PCs. A second home PC or portable computer (laptop) is excluded from this, if this second computer is exclusively used by you. 5. Support Services MACROPOOL may provide you with support services related to the SOFTWARE. Use of Support Services is governed by the MACROPOOL policies and programs described in the user manual, in online documentation, and/or other materials provided by MACROPOOL, as they may be modified from time to time. Any supplemental SOFTWARE code provided to you as part of the Support Services shall be considered part of the SOFTWARE and subject to the terms and conditions of this EULA. With respect to technical information you provide to MACROPOOL as part of the Support Services, MACROPOOL may use such information for its business purposes, including for product support and development. MACROPOOL will not utilize such technical information in a form that personally identifies you. 6. Termination Regardless of other rights, MACROPOOL can cancel this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you are committed to remove ContentSaver from your system completely, including your personal license data. 7. Limitation of Liability MACROPOOL is not responsible for any damages whatsoever, including loss of information, interruption of business, personal injury and/or any damage or consequential damage without limitation, incurred before, during or after the use of our products. Excluding damages, which have been originated through gross negligence or intention of MACROPOOL. Our entire liability, without exception, is limited to the customers' reimbursement of the purchase price of the software (maximum being the suggested retail price as listed by MACROPOOL) in exchange for the return of the product, all copies, registration papers and manuals, and all materials that constitute a transfer of ownership from the customer back to MACROPOOL. 8. Using Copyrighted Content Using, copying or distributing copyrighted content or documents from the Internet may violate copyright laws. Compliance with the copyright law remains your responsibility. Users who infringe on copyrights may be held liable by the copyright owner. 9.
