THE ACCEPTANCE BY CRANHAM HAIG LIMITED OF ANY PURCHASE ORDER PLACED BY YOU IS EXPRESSLY MADE CONDITIONAL ON YOUR ASSENT TO THE TERMS SET FORTH HEREIN, AND NOT THOSE IN YOUR PURCHASE ORDER. You acknowledge that this Agreement allocates the risks of use of the Software between you and CRANHAM HAIG LIMITED, and that the license fee(s) for the Software reflect the limited warranties, limitation of liability and allocation of risk under this Agreement. Had there been a different allocation of risk, the pricing and terms of this Agreement would also have been different. If any remedy provided in this Agreement is determined to have failed of its essential purpose, CRANHAM HAIG LIMITEDs entire liability shall in no event exceed the license fees paid by you for the Software. If any provision of this Agreement is held to be void or unenforceable, such provision shall be reformed only to the extent necessary to make it enforceable and the remaining provisions of the Agreement will remain in full force and effect.
