Etymonix SoftReel codec is a faster than real-time MPEG-2 video decoder optimized for single-core and multi-core systems. It enables smooth high-quality playback of native MPEG-2 SD and HD video streams in DVB applications, Windows Media Player and other DirectShow-compatible products. Etymonix(tm) SoftReel(tm) License Agreement IMPORTANT - READ CAREFULLY: By installing, copying, accessing or otherwise using the Etymonix SoftReel MPEG-2 video decoder, you (either an individual or an entity) agree to be bound by all of the terms of this license agreement. If you do not agree to the terms and conditions of this license agreement in their entirety, do not install or use this product. The Etymonix SoftReel MPEG-2 video decoder is a shareware product and its extended use requires a valid license. A 30- day trial period is allowed for evaluation purposes only. After that period, you must either purchase a valid license or remove the product from your system. Definitions "PRODUCT": The Etymonix SoftReel MPEG-2 video decoder, including, but not limited to, any related components purchased or provided with the PRODUCT, application programming interfaces, associated media, printed materials, online or electronic documentation, and any subsequent updates and maintenance releases. "LICENSE KEY": If applicable, a serial number or license file issued to you by Etymonix to install and use the PRODUCT. "TRIAL PRODUCT": A trial version of the PRODUCT which can be installed without a LICENSE KEY and can be used for a limited duration. "DEMO PRODUCT": A full version of the PRODUCT with a no-cost temporary LICENSE KEY, provided for evaluation and demo purposes only. Temporary LICENCE KEYs have an expiration date. "LICENSED PRODUCT": A full version of the PRODUCT with a permanent LICENSE KEY. "COMPUTING DEVICE": A single physical computer or an instance of an emulated or virtual hardware system, including but not limited to a handheld or portable device, an embedded system, a notebook, a desktop or a server. Multiple computers that share processing power or operate in a networked configuration as a single logical computer, such as a server farm or similar arrangement, constitute multiple COMPUTING DEVICEs. Ownership All versions of the PRODUCT are the sole property of Etymonix and are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The PRODUCT is licensed, not sold. License Grants Etymonix grants you a non-exclusive, non-transferable license to install and use the PRODUCT on a number of COMPUTING DEVICEs less than or equal to the number of licenses purchased and/or specified by a LICENSE KEY, unless permitted otherwise by your payment of applicable license fees under an Etymonix approved licensing model. If applicable, you may install and use the DEMO PRODUCT until its expiration date only to evaluate the suitability of the PRODUCT for licensing on a for-fee basis. You may store one copy of the PRODUCT on a storage device, such as a network server, that is only accessible to other computers on an internal network. You may use that copy to install the PRODUCT on any other COMPUTING DEVICE to which a license has been assigned. You must obtain and dedicate a license for each separate COMPUTING DEVICE on which the PRODUCT is run (regardless of whether it is run concurrently or not). You may make a reasonable number of copies of the PRODUCT solely for backup or archival purposes. Except as expressly provided in this license agreement, you may not otherwise make copies of the PRODUCT. Use of the PRODUCT in any manner that complies with the MPEG-2 standard is expressly prohibited without a license under applicable patents in the MPEG-2 Patent Portfolio, which license is available from MPEG LA at http://www.mpegla.com/. All rights not expressly granted are reserved by Etymonix. Limitations You may not: i. modify, reverse engineer, decompile, disassemble, adapt, merge, translate, reduce to human readable form or debug the PRODUCT in whole or in part, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation; ii. add, modify or remove files from the original distribution package or repackage the PRODUCT; iii. create derivative works based upon the PRODUCT in whole or in part; iv. add, modify or remove any titles, trademarks or trade names, copyright notices, legends, logos, or other proprietary markings on the PRODUCT; v. use the PRODUCT for purposes that violate copyright laws or copyrighted material; vi. distribute the LICENSED PRODUCT or LICENSE KEY provided by Etymonix or one of its distributors without a valid distribution license; or vii. duplicate, sell, rent, lease, lend, license, sublicense, share, publish, distribute or utilize the PRODUCT in any manner not described herein without written consent of Etymonix. This license agreement does not grant you any rights in connection with any copyrights or trademarks of Etymonix. Distribution Inclusion of this PRODUCT as part of a software and/or hardware package requires a special distribution license. Parties interested in licensing the PRODUCT for distribution should contact Etymonix at [email protected]. Online services including BBSs, WWW sites and FTP sites which do not charge for file downloads or for online access time may make the TRIAL PRODUCT available for downloading. Shareware sites may freely distribute the TRIAL PRODUCT. Shareware CD-ROM distributors that charge a copying/distribution fee of no more than US$10 may distribute the TRIAL PRODUCT without a special distribution license, provided that users are informed that they are not purchasing the PRODUCT and that they must contact Etymonix to legally obtain a license for the PRODUCT. Support and Feedback Etymonix may provide you with limited support services related to the PRODUCT. Etymonix is under no obligation to provide you with support services during your use of the TRIAL PRODUCT or DEMO PRODUCT. Any supplemental software code or related materials that Etymonix provides to you as part of the support services shall be considered part of the PRODUCT and subject to the terms and conditions of this license agreement. Etymonix may use any technical information, idea or suggestion you provide to Etymonix for any Etymonix business purposes without restriction, including for product support and development. Etymonix will not use information in a form that personally identifies you. Termination Without prejudice to any other rights, Etymonix may terminate this license agreement if you fail to comply with its terms and conditions. In such event, you must uninstall and destroy all copies of the PRODUCT and all of its component parts. Furthermore, Etymonix reserves the right not to refund registered users who are in violation of this license agreement. No Warranties To the maximum extent permitted by law, Etymonix disclaims all warranties pertaining to the PRODUCT, expressed or implied, including but not limited to warranties of merchantability and fitness for a particular purpose. In no event shall Etymonix be liable for any loss (including but not limited to loss of profit, loss of business information, business interruption, or any other loss) or damage (including but not limited to direct, indirect, special, consequential, punitive, incidental or other damages) arising out of the use or inability to use this PRODUCT even if Etymonix is aware of the possibility of such damages or known defects. The entire risk arising out of use or performance of the PRODUCT remains with you. Limitation of Liabilities Etymonix' entire liability and your exclusive remedy under this license agreement shall be, at Etymonix' discretion, either (a) the refund of the registration or license fee, or (b) the repair or replacement of the PRODUCT. This limited liability is void if failure of the PRODUCT has resulted from accident, abuse, or misapplication. Miscellaneous This license agreement is governed by the laws in force in the Province of Quebec, Canada; and, in the event of any dispute which may arise hereunder, you consent to the exclusive jurisdiction of the federal and provincial courts sitting in Laval, Quebec. If for any reason a court of competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of this license shall continue in full force and effect. Terms of this license agreement may change in future versions of the PRODUCT. Before upgrading to a future version of the PRODUCT, you must accept the terms of the new license agreement.
