FLASHSLIDER LICENSE AGREEMENT LICENSE TERMS FOR FLASHSLIDER Please read this License Agreement before using this software. By using this software, you are agreeing to be bound by the terms of this License. If you do not agree to these terms, promptly cease all further installation or use of the software. DEFINITIONS In this Agreement, "AUTHOR" means "Flarium Ltd.", the author of this software; "LICENSEE" means you, the licensee of the software; "SOFTWARE" means the FlashSlider, being understood that FlashSlider is a commercial product, including any technology and utility software licensed by AUTHOR with all accompanying documentation. LICENSE In consideration of your undertaking to comply with the terms and conditions of this License Agreement, AUTHOR grants you, LICENSEE, a non-exclusive license to use the Software and to view the documentation on a single computer system. It is also agreed that the License granted to the LICENSEE pertaining to FlashSlider is non-transferable. LICENSEE may not use the Software on a network server or on more than one computer terminal at the same time. This Agreement does not grant LICENSEE any rights to patents, copyrights, trade secrets, trade names, trade marks (whether registered or unregistered), or any other rights, functions or licenses in respect of the Software. COPYRIGHT AND RESTRICTIONS ON USE The Software contains copyrighted material and, in its human readable form, it contains trade secrets and proprietary information owned by or licensed to AUTHOR. Title to and ownership of the Software and the documentation that accompanies the Software and all intellectual property rights in the Software and said documentation are and shall remain the sole property of AUTHOR and/or his licensors. LICENSEE may not de-compile, reverse engineer, disassemble or otherwise reduce it to human readable form. LICENSEE may not modify, rent, lease or loan the Software. LICENSEE may not create derivative software based upon any trade secret or proprietary information of the Author and/or his licensors. LICENSEE may not sub-license, assign or transfer this License. LICENSEE may make one copy of the Software for backup or archival purposes, provided that LICENSEE duplicates the copyright notice and other identifying information on the disk's label and affix such notice to the backup copy. LICENSEE may print a copy of the documentation from the disk only for LICENSEE's use for the sole purpose of operating the Software. UPGRADE POLICY 1. Minor updates. When you purchase the FlashSlider Software, you will get minor updates and bug fixes for free. Minor updates are updates of which the first version number has not changed. For example, if you buy version 4.x.x, you can upgrade to any other version 4.x.x free of charge. 2. Major upgrades Major upgrades are indicated by a change in the product version number. So an upgrade from 4.x.x to 5.x.x is a major upgrade. Major upgrades usually have a significant amount of improvements and new features. Therefore, you will likely have to pay an upgrade fee if you want to take advantage of a major version upgrade. As a major upgrade is paid, the previous version will remain available for those who purchased it in the past and have no need to upgrade. You will never be forced to upgrade. You will still be entitled to technical support if you continue to use the previous version. However, you will not receive any further updates with improvements or new features. If a major upgrade is released less than a month after you've purchased FlashSlider, you will receive the major upgrade free of charge. SPECIAL DISTRIBUTION RIGHTS The FlashSlider Software may be freely distributed, provided that: 1. Such distribution included only the original archive supplied by the Author. You may not alter, delete or add any files in the distribution archive. 2. The distribution does not include a registration number. In particular, you may not distribute a registered piece of software. 3. No money is charged to the person receiving the FlashSlider Software, beyond reasonable cost of packaging and other overhead. ENTIRE AGREEMENT This agreement constitutes the entire agreement between you and Author and supersedes any other prior agreements or communications regarding the Software. If any provision of this agreement is held invalid, the remainder of this agreement shall continue in effect.
