BY INSTALLING OR USING THE SOFTWARE YOU ACCEPT THE TERMS OF THIS AGREEMENT. IF YOU SHOULD NOT AGREE TO THE TERMS OF THIS AGREEMENT, YOU ARE NOT ENTITLED TO INSTALL AND USE THE SOFTWARE. 1. LICENSER. SOFTWARE: "Software" are all digital informations in form of computer files, you have acquired by download respectively all digital informations on a data medium, the data medium itself and additional written informations that you have obtained by acquire Flexionizer. Furthermore to the Software belong additions respectively modified versions of this computer files ("Updates"). 3. GRANT OF LICENSE. The licenser grants you a non-exclusive right (license) to install and use the Software according to the terms below. 3.1 Installation and Use. You may install and use one (1) copy of the Software on your Computer. The main user of the Computer on which the Software is installed may install and use a (1) second copy of the Software on a portable Computer. 3.2 Backup Copies. You are allowed make an adequate number of copies of the Software, on condition that these copies are not used for other purposes than to protect against loss of data. 3.3 Single Use In any case the software may not be used on different computers or from different users in the same time. 4. The licenser does not warrent that the software is free of errors. The warrenty claim includes in case of a defective data carrier the exchange of the data carrier, in case of a defective software itself the act of fixing or by cancellation the licence agreement in connection with refund the puchase price. The decision about this makes the licenser. As far as te licensee has puchased the CD version of Flexionizer the ruturn of the software is required for an exchange or the refund of the purchase price. Further warrenty claims or recompensation are excluded. The warrenty claim has to be raised within the warrenty period of ninety (90) days.. IN NO CASE THE LICENSER WILL BE LIABLE FOR DIRECT OR INDIRECT DAMAGES, CONSEQUENTIAL DAMAGE, LOSS OF DATA, LOSS OF PROFIT, LOSS OF SAVINGS OR ANY OTHER FINANCIALLY LOSS AS A RESULT OF USING THE SOFTWARE. 7. GOVERNING LAW. This agreement and its interpretation shall be governed by and construed in accordance with the law of the Federal Republic of Germany. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. 8. GENERAL PROVISIONS. 8.1 This agreement is translated to other languages. In case of contradictions as for interpreting or construing this agreement, only the German version will be the used. 8.2 Demo Version. The Software can be obtained for purposes of demonstration and evaluation as a Demo-Version that is free of charge. In this case the software contains a limited functionality respectively a time limit. 8.3 Severability Clause. In case that any of these provisions in this agreement are invalid or unenforceable, the validity of the remaining provisions shall be unaffected. Instead of the invalid or unenforceable provision there shall be replaced a valid and enforceable provision that is equivalent in its business effects the contracting parties actually wanted to have determined.
