Pragmaticomm Limited End User Licence Agreement Definitions AUTHOR refers to Pragmaticomm Limited. PRODUCT refers to software and all accompanying intellectual property provided by Pragmaticomm Limited which are made available under this agreement. USER refers to you, whether acting as an individual or as a representative of another individual or corporation. Agreement This End User Licence Agreement (EULA) is a legal agreement between the USER and the AUTHOR. By using any part of the PRODUCT you agree that you have read, fully understood and agreed to be bound by the terms of of this agreement, set out below. Jurisdiction USER and AUTHOR agree that this agreement and USERs relationship with AUTHOR shall be governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English courts. Copying USER may make and distribute unmodified and complete copies of the PRODUCT, provided USER charges absolutely no fees to the recipients of such copies and copies of the PRODUCT are accompanied by a verbatim copy of this Agreement. USER also agrees to cease offering copies of the PRODUCT on receipt of a request to do so by the AUTHOR. Any other redistribution of the PRODUCT without prior written permission by the AUTHOR is prohibited. Third Party Components PRODUCT may include third party components or their derivatives. USER agrees to be bound by the copyright terms and conditions that apply to any such components. Such terms and conditions are included in the PRODUCT as file(s) whose name contains the term COPYRIGHT. Licence USER is granted a limited non-exclusive commercial licence to use the PRODUCT subject to the terms of a licence file. USER agrees that a licence file may place time or other use limits on USERs use of the PRODUCT. Whether USER has received a licence file or not, USER agrees to neither attempt to circumvent, by whatever means, the PRODUCTs licence functionality, nor assist others in doing so. All other intellectual property rights are reserved by the AUTHOR. Liability USER agrees that AUTHOR shall not be responsible for any direct, indirect, consequential, accidental or incidental damages related to the use of the PRODUCT. These include, but are not limited to, damages for loss of profits (business and individual), interruption (business and individual), loss of data (business and individual) and other possible damages arising out of the use or inability to use the product. Trial Period USER agrees that the PRODUCTs licencing facility allows limited, no-fee use of the PRODUCT for evaluation purposes. USER agrees that obtaining, from AUTHOR, a paid, non-trial licence file, constitutes acceptance by the USER that USER has found the PRODUCT fit for USERs needs.
