User License Effective Automated Systems Engineering(EASE) is owned and operated by William R. Conner. Each copy of EASE Project Management Software (EASE PMS) consists of the pkzip package of EASE PMS files downloaded from the EASE web site and the key file emailed (or otherwise transmitted by agreement between EASE and the purchaser) upon purchase agreement and payment. The key file will in all cases be encoded with the Name of the Person receiving the license(hereinafter referred to as the Licensee), the applicable organizational name, the address of that organization and the license number assigned by EASE. The Licensee is solely responsible for providing the Licensee, organization, and address information. However, EASE may reject information which it recognizes to be fraudulent, obscene, or unreasonably defaming to a person or group. In order that the EASE PMS system will work with full capability (notably capability to print and save), the key file must be placed in the same MS Windows computer folder (aka directory) with those files extracted from the above noted pkzip package. The Name/Organization/Address/License # of the Licensee will appear on a Splash Screen along with the system name, version number and copyright notice when the application is launched and when Menu Selection Help|Splash Screen Copyright Notice is selected. Protections against the unauthorized modification of this information are built into the program and such unauthorized modifications will cause the application to cease operation. Should the Licensee fail to make complete payment for EASE PMS, the License is revoked and that key file (and any copies made) must be erased rendering EASE PMS operable only as a demo system without save or print capabilities. Each license is for a single installation. The license is for one or more simultaneous users as specified on purchase. The software regulates the number of simultaneous users. The license is for the Licensee only and is non-transferable. It is anticipated that updates to the system may be released from time to time. Such updates, if released as the same major version will be available on the EASE web site at no cost to the Licensee other than expenses incurred with the necessary download. (A major version will be designated by the number to the left of the first decimal in the version number. That is, Versions 1.0, 1.01 and 1.1 are all of major version 1. Versions 2.0, 2.05 and 2.2 are all of major version 2.) A key file will work only with same major version for which it was released. Releases at the same major release level will include fixes for problems encountered and enhancements released at the option of EASE. EASE has tested the PMS software and knows of no potential for system failure, output errors or loss of data. EASE has not employed outside testers who simulate the antics of the error prone or inexperienced user. EASE therefore advises the users of EASE PMS to frequently back up data files and review output for reasonableness. EASE would like to be informed of problems encountered by users and will update the software to fix any problems even if resulting from operator error. Note that with a previous system (C-NETT PMS authored and released by Mr. Conner) no major (and very few minor) problems occurred over 10 years of use. The liability of EASE and William R. Conner for any damages resulting from the use and/or any failure of EASE PMS will be limited to the refund of payment made for EASE PMS to EASE by the Licensee. Such a refund will be made if the Licensee establishes that EASE PMS has failed to perform as should reasonably be expected and that the failure is major in the view of EASE.
